NEW REGULATIONS
Since the 2024 updates to the Canada Shipping Act, small commercial marine operations are under increased scrutiny. Combined with a tightening insurance market, it is now mandatory for small businesses to demonstrate a functional Safety Management System (SMS).

Class 4B Vessels
Definition: Vessels 15 Gross Tonnage (GT) or less that are either passenger-carrying vessels (e.g., water taxis, charters, tour boats) or tugs/towboats.
Overdue as of July 2026:
The Marine Safety Management System Regulations Second Anniversary – SSB No.: 05/2026 Transport Canada can inspect your vessel at any time.
Class 5 Vessels
Definition: Commercial workboats, cargo vessels, or small fishing vessels 15 GT or less that do not carry passengers and are not towboats.
Due as of July 2027:
The Law: While you do not need to apply for Transport Canada formal certificates (CDOC/CSMC), you are legally mandated to maintain and follow a documented SMS on board as of July 2027.
